SMS Marketing & AI Messaging Services

1. Program Name & Description
Program Name: IntelliLink AI Automated Messaging Program
Program Description: IntelliLink AI Systems provides AI-powered automated customer
messaging and SMS marketing services for local businesses including restaurants, salons,
gyms, and other small businesses. Through this program, participating businesses send
automated text messages to customers who have opted in to receive communications including
but not limited to:

• Business hours, specials, and promotions
• Appointment reminders and booking confirmations
• Exclusive discounts and VIP offers
• Flash deals and limited-time offers
• New product or service announcements
• General business updates and announcements

 

These messages are sent on behalf of IntelliLink it's business clients using the Twilio SMS
platform and managed through ManyChat automation software.

 

2. Eligibility & Opt-In Consent
By providing your phone number and opting into an SMS program managed by IntelliLink AI
Systems, you confirm that:

• You are at least 18 years of age.
• You are the account holder or have the account holder's permission for the phone
number provided.
• You consent to receive recurring automated marketing text messages from the business
whose program you opted into.
• Your consent to receive text messages is not a condition of any purchase.

Opt-in may occur through Instagram or Facebook direct message flows, website opt-in forms,
QR codes, or in-person sign-up at a participating business location.

 

3. Message Frequency
Message frequency varies by participating business and campaign. You can expect to receive
approximately 6 to 12 messages per month per business program you are enrolled in, though
frequency may be higher during promotional periods, holidays, or special events.
IntelliLink AI Systems and its business clients reserve the right to adjust message frequency at
any time. We are committed to not over-messaging and maintaining a respectful communication
frequency.

4. Message & Data Rates
Message and data rates may apply. Standard SMS and data rates charged by your mobile
carrier apply to all messages sent and received through our programs. IntelliLink AI Systems is
not responsible for any charges applied by your wireless carrier.
Charges vary by carrier and plan. Please contact your mobile carrier if you have questions
about your messaging rates or data plan.

 

5. Opt-Out Instructions
You may opt out of receiving SMS messages at any time. To unsubscribe, reply STOP to any
text message you receive from our program. After texting STOP, you will receive a one-time
confirmation message confirming your opt-out. No further messages will be sent to your number
unless you re-opt in.

 

To opt out of ALL programs managed by IntelliLink AI Systems, reply STOP ALL to any
message.

 

Please note that opting out of SMS messages does not unsubscribe you from email
communications or other marketing channels.

7. Privacy & Data Use

Your privacy is important to us. All personal information collected through our SMS programs is
governed by the IntelliLink AI Systems Privacy Policy, available at

We will never sell, rent, or share your phone number with third parties for their own marketing
purposes. Your information is used solely to deliver the messaging services you have opted into
and to improve our services.

 

8. Legal Compliance
IntelliLink AI Systems operates all SMS marketing programs in compliance with applicable
federal and state laws, including:
• The Telephone Consumer Protection Act (TCPA)
• The CAN-SPAM Act
• Mobile Marketing Association (MMA) guidelines
• CTIA Messaging Principles and Best Practices
• A2P 10DLC registration requirements for application-to-person messaging
All SMS programs managed by IntelliLink are registered with The Campaign Registry (TCR) as
required by US mobile carriers.

 

9. Client Business Responsibilities
Business clients of IntelliLink AI Systems agree to the following:
• Only send messages to customers who have explicitly opted in to receive SMS
communications.
• Maintain opt-in records and make them available upon request.
• Not use the service to send spam, illegal content, or messages that violate carrier
guidelines.
• Promptly honor all opt-out requests processed through the system.
• Ensure all promotional content is accurate and not misleading.
IntelliLink AI Systems reserves the right to suspend or terminate service to any client found to
be in violation of these responsibilities or applicable law.
10. Limitation of Liability
IntelliLink AI Systems shall not be liable for any delays, failures, or interruptions in SMS delivery
caused by mobile carriers, platform outages, or circumstances beyond our reasonable control.
We do not guarantee delivery of any specific message.
To the maximum extent permitted by law, IntelliLink AI Systems shall not be liable for any
indirect, incidental, special, consequential, or punitive damages arising from your use of our
services.

 

11. Changes to These Terms
IntelliLink AI Systems reserves the right to modify these Terms at any time. When we make
material changes, we will update the effective date at the top of this document and notify clients

via email or website notice. Continued use of our services following any changes constitutes
acceptance of the revised Terms.
We encourage you to review these Terms periodically to stay informed of any updates.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of
New Jersey, without regard to its conflict of law provisions. Any disputes arising under these
Terms shall be subject to the exclusive jurisdiction of the courts located in Ocean County, New
Jersey.
